By agreeing to the terms of this Privacy Policy and entering the information required to open a nikelX account on the Website http://abt.mpass.cloud (hereinafter referred to as the Website), the nikelX USER:

• confirms the details entered are his/her personal details
• confirms he/she has read and understood this Privacy Policy in its entirety and the terms and conditions governing the processing and use of personal details entered when creating the nikelX account
• agrees to the processing by the Website of personal information entered for the purpose of concluding this Agreement and its further execution
• agrees to the terms and conditions set out for the processing of personal data

The USER agrees to the processing of his/her personal data, by conscious action as required by government legislation and confirms that, in giving this consent, he/she does so freely, without constraint and in his/her own interests.

Agreement to the processing of personal data by the USER constitutes a discrete, informed and conscious action.

By this action the USER acknowledges agreement to the processing of the following personal data:

• mobile telephone number
• email

The USER agrees to hemse.one GmbH performing the following operations using his/her personal details/data:

• collection and accumulation
• retention for the period required by government regulations for report retention but not less than three (3) years from the moment the USER ceases using the nikelX service
• their use
• their destruction
• their depersonalization
• their submission by court order, including to third parties, whilst ensuring their security from unsanctioned access

This Agreement comes into force from the moment personal data is entered and has no time limit. It may be revoked by contacting the Website Administrator, listing data to be deleted, as per current government legislation.

Withdrawal of agreement to the processing of personal data may be made by the USER sending an email to: info@mpass.cloud.

The Website is not responsible for the use (either legally or illegally) by third parties of information entered by the USER on the site, including its reproduction and distribution by whatever means.

The Website and Application includes Google Maps features and content and use of Google Maps features and content is subject to the then-current versions of the: (1) Google Maps/Google Earth Additional Terms of Service at https://maps.google.com/help/terms_maps.html; and (2) Google Privacy Policy at https://www.google.com/policies/privacy/.

The Website has the right to amend this Agreement. The date of the latest amendment is shown when making changes to the current Agreement. Any new version of the Agreement comes into force from the moment it is placed on the Website, unless this procedure is altered in any new version of the Agreement.

This Agreement and any matters between the USER and the Website arising from the application of the Agreement are regulated by government legislation.
